AGB Adventurebase GmbH - Flightbase
Flightbase is a product of Adventurebase GmbH.
Flightbase's deliveries, services, offers and arrangements are based exclusively on these terms and conditions. By ordering a voucher or registering for an experience, these terms and conditions are deemed to have been accepted. The order or registration can be made in writing or verbally. The buyer's general terms and conditions are hereby rejected.
Flightbase organizes and arranges flight experiences throughout Switzerland and nearby countries with various operators. The bookings are made through the sale of value vouchers or through direct placement.
Only value vouchers are available. The value is shown on the invoice and can be requested at any time. Value vouchers can be freely credited to any Flightbase offer within the validity period. An offer chosen by the customer can be described and printed on the voucher, but this is not binding for redemption.
4.1 Brokerage contract
The brokerage contract is created when the buyer places an order or registers on the website and accepts the general terms and conditions. An order by telephone or e-mail replaces the order by online form. The organizer alone is responsible for the implementation. In this case, Flightbase is the agent and not the organizer. When registering for the flight experience, the customer receives the contact details of the organizer and concludes a separate contract with the organizer for the performance. This contract for the use of the respective experience is concluded directly between the participant in the experience and the respective experience partner (organizer). The legal relationship between the customer and the experience partner (organizer) is governed exclusively by the general terms and conditions of the experience partner. Vouchers are credited against the experience partner's offer.
4.2. Sales documents
The information in our sales documents (descriptions, drawings, illustrations, dimensions, weights and other services) are to be understood as guidelines only and do not constitute a guarantee of properties, unless they are expressly designated as binding in writing. Flightbase accepts no responsibility for product information provided by partners.
Prices are subject to change and printing errors excepted.
6.1 Payment for vouchers
Payment for vouchers is made by invoice or online payment. Vouchers are only valid after receipt of the full invoice amount and can be credited to an offer. The payment term of the invoice remains the same in this case.
6.1.1 Payment of vouchers by installment
Vouchers can be paid for in installments under the following conditions:
- The request for payment by installments must be entered in the comments field when ordering the voucher.
- The first installment must be at least 1/4 of the total amount and must be paid within 30 days of completing the order.
- The remaining installments can be chosen freely. The remaining installments can be chosen freely, but the total amount must be paid no later than 12 months after completion of the order.
- Direct registrations cannot be paid in installments.
6.2 Payment of registrations
Payment for direct registrations is made by invoice or online payment and must be made at least 3 days before the event. If the customer fails to make the payment on time, Flightbase may cancel the activity. In this case, however, the customer is not released from their contractual obligations to register and the cancellation fees will be charged.
6.3. Payment from abroad
Bank charges for bank transfers from abroad are to be borne by the customer. The voucher or registration will not be activated until the invoice amount has been paid in full.
7.1 Validity of vouchers
The value of the voucher remains valid for up to 10 years in accordance with the Swiss Code of Obligations. During these 10 years, each voucher can be credited to any Flightbase and Adventurebase offer.
7.2. Extension
The value of the voucher can be extended free of charge in increments of one year up to a maximum of 10 years.
7.3. Cash payment
A cash payment of the voucher amount is not possible.
7.4. Transferability
The vouchers are freely transferable and are not issued to a specific person. In the event of loss or theft of a voucher, Flightbase accepts no liability for unlawful redemption.
7.5. Validity of registrations
7.5.1. Registrations with vouchers
Registrations with vouchers are valid for a maximum of 3 months after the registration date at the price paid. In the event of a later execution, the difference between the voucher and the current offer price must be paid.
7.5.2 Registrations without a voucher
Registrations without a voucher will be executed at the paid price for a maximum of 3 months after the registration date. In the event of later execution, the difference to the current offer price must be paid.
8.1 Shipping costs in Switzerland
Shipping costs for sending vouchers in Switzerland are borne by Flightbase. There are no extra costs for the customer.
8.2. Shipping outside Switzerland
Vouchers are available abroad as a download. No vouchers are delivered abroad by post.
8.3 Delivery and performance times
Delivery dates and delivery times are non-binding, unless expressly agreed otherwise in writing. The specification of certain delivery periods and delivery dates by Flightbase is subject to the correct and timely delivery to Flightbase by suppliers and manufacturers.
8.4. Default of acceptance
If the buyer refuses to accept the delivery items after the expiry of a grace period set for him or declares that he does not wish to accept the goods, Flightbase can refuse to fulfill the contract and demand compensation for non-fulfillment. Flightbase is entitled to demand either a lump sum of 25% of the agreed purchase price or compensation from the buyer for the actual loss incurred.
8.5. Defects
Visible differences in quantity must be reported to Flightbase and the carrier in writing immediately upon receipt of the goods, hidden differences in quantity within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or poor packaging must be made immediately upon receipt of the consignment.
8.6. Transfer of risk
The risk is transferred to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of our own, the risk is transferred to the buyer upon notification of readiness for shipment. If Flightbase assumes the transportation costs, this has no influence on the transfer of risk.
9.1 Return of vouchers
Vouchers can be canceled up to 20 days after the order date for a processing fee of CHF 25 per voucher. If the voucher has not yet been sent, the processing fee does not apply. The vouchers do not have to be returned to Flightbase.
9.2 Excluded from returns
Products that are not directly related to the voucher cannot be returned.
9.3 Exchange / crediting of vouchers
The value of the voucher can be credited to a new voucher order or to a new registration for any Flightbase offer during the validity period.
10.1. Anmeldungen
Anmeldungen sind verbindlich. Zur Absicherung bei Krankheit, Unfall, usw., empfehlen wir den Abschluss einer Reiserücktritts-/Annullierungskosten-Versicherung. Der Abschluss dieser Versicherung liegt in der Verantwortung des Kunden.
10.2. Stornierungen und Verschiebungen von Anmeldungen
Termine können schriftlich über das entsprechende Webformular abgesagt oder verschoben werden. Es werden nur schriftliche Absagen oder Verschiebungen per Webformular oder Briefpost während den Geschäftszeiten von 08:00 bis 17:00 Uhr von Montag bis Sonntag akzeptiert. Absagen die ausserhalb der Geschäftszeiten getätigt werden, werden auf die nächstmögliche Geschäftszeit datiert. Massgeblich ist das Datum des Eingangs der Erklärung bei Flightbase.
10.2.1 Absage mehr als 48h vor dem Termin:
Bearbeitungsgebühr von CHF 25.- / Person (Ausnahme: CHF 30.- bei den Simulatoren B777, F/A-18, EC120, Space)
10.2.2 Verschiebung mehr als 48h vor dem Termin:
Bearbeitungsgebühr von CHF 25.- / Person. (Ausnahme: CHF 30.- bei den Simulatoren B777, F/A-18, EC120, Space)
10.2.3 Absage oder Verschiebung zwischen 48h und 24h vor dem Termin:
Gebühr von 30% des Gesamtpreises.
10.2.4 Absage oder Verschiebung innert 24h oder weniger vor dem Termin:
Gebühr von 100% des Gesamtpreises.
10.2.5 Sonderregelung für alle Fallschirmangebote in Triengen:
Bei Verschiebungen 8 Tage oder später vor dem Sprungtermin, wird eine Bearbeitungsgebühr von CHF 125.- verrechnet. Bei einer Absage des bestätigten Termins mehr als 8 Tage vor dem Termin werden CHF 50.- und ab 7-3 Tage vor dem Termin CHF 125.- verrechnet. Bei einer Absage nach 24h vor dem Treffpunkt verfällt der Gutschein oder der Gesamtpreis des Angebotes wird in Rechnung gestellt.
10.2.6 Sonderregelung für alle Fallschirmangebote in Beromünster:
Bei einer Absage des bestätigten Tandemsprungs 72-24 Stunden bzw. des AFF Erstabsprunges von weniger als 1 Woche vor dem Termin, wird zusätzlich zur oben genannten Gebühr eine Annullationsgebühr von CHF 100.- pro Teilnehmer erhoben. Bei einer Absage nach 24h vor dem Treffpunkt verfällt der Gutschein oder der Gesamtpreis des Angebotes wird in Rechnung gestellt.
10.2.7 Sonderregelung für alle Fallschirmangebote in Reichenbach
Bei einer Absage innert 48h vor dem Termin, wird eine Stornogebühr von 100% fällig.
10.2.8 Sonderregelung für alle Ballonfahrtangebote (ausgenommen Regionen aus Punkt 10.2.9):
Ballonfahrten können bis 72 Stunden vor dem eigentlichen Fahrtermin gegen eine Stornogebühr von CHF 25.- pro Person abgesagt werden. Bei einer Stornierung zwischen 72 und 48 Stunden vor der Fahrt werden 50 % des Betrages und bei einer Stornierung innerhalb der letzten 48 Stunden vor der Fahrt 100% als Stornogebühren fällig.
10.2.9. Sonderregelung für alle Ballonfahrtangebote in Biel, Fribourg, Genf, Lausanne:
Eine Anmeldung für diese Ballonfahrten kann bis 13 Personen nicht storniert werden. Die Anmeldung behält für 24 Monate ihre Gültigkeit und verfällt danach. Bei einer wetterbedingten Absage verlängert sich die Gültigkeit der Anmeldung um 4 Monate. Gruppenflüge ab 13 Personen können bis 31 Tage vor dem Flugtermin ohne Kostenfolge storniert werden. Zwischen 30 und 15 Tage vor dem Flugtermin wird eine Stornogebühr von 55% fällig. Nach 15 Tagen vor dem Flugtermin wird eine Stornogebühr von 100% fällig.
10.2.10 Sonderregelung für alle Kampfjetangebote:
Werden reservierte Kampfjetflüge bis 5 Tage vor dem reservierten Datum vom Kunden abgesagt, wird eine Stornogebühr von 35% des Angebotspreises fällig. Bei Absagen von reservierten Kampfjetflügen nach 5 Tage vor dem reservierten Datum, wird 100% des Angebotspreises als Stornogebühr verrechnet.
10.2.11 Sonderregelung für Heliskiing Angebote:
Abmeldung bis 10 Tage vor der Tour: 50% des Tourenpreises.
Abmeldung bis 9 - 0 Tage vor der Tour: 100% des Tourenpreises.
Es wird in jedem Fall ein Verwaltungskostenbeitrag von CHF 80.- erhoben. Bei Abbruch der Tour durch den Teilnehmer besteht kein Anspruch auf Rückerstattung.
10.2.12 Sonderregelung für Gleitschirmflug Zürich Incredible:
Abmeldungen bis 3 Tage vor dem Flug: CHF 25.- pro Person. Abmeldung weniger als drei Tage vor dem Flug: 100% vom Flugpreis
10.3. Anmeldungen von Gruppen
Bei Anmeldungen für Gruppen (mehrere Personen) übernimmt die anmeldende Person die Verantwortung diese AGB's an alle Teilnehmer weiterzugeben und haftet für allfällige Annulationskosten aller Teilnehmer.
10.4. Stornierung / Verschiebung durch Flightbase
Flightbase und ihre Partner können bestätigte Termine aus wichtigen Gründen (Wetter, Anzahl. Teilnehmer, kurzfristige Absage von Teilnehmer, technische Gründe, Sicherheitsgründen, usw.) absagen oder verschieben. Umtriebs Kosten für Anreise, Verpflegung, etc. gehen zu Lasten des Teilnehmers und werden nicht von Flightbase übernommen. Die Termine werden bei einer Absage durch Flightbase auf ein neues Wunschdatum des Kunden verschoben. Eine automatische Verschiebung auf das bei der Anmeldung angegebenen 2. Wunschdatum oder eine provisorische Reservation des 2. Wunschdatum ist nicht möglich. Eine Rückgabe des Gutscheins oder des Tickets durch den Kunden bei einer Absage der Aktivität durch Flightbase und ihrer Partner ist grundsätzlich nicht möglich. Eine Rückerstattung ist im Ausnahmefall möglich, wenn der Kunde kein Ersatzdatum anbieten kann. Dieser Umstand muss bei der Anmeldung angegeben werden.
11.1 Flight times and offer description
The flight times stated in the product descriptions and registration confirmations are approximate and may vary depending on weather, wind and safety reasons. The pilot may postpone take-offs and locations at short notice for weather and safety reasons. If an activity is canceled early by the customer, the activity is deemed to have been carried out. In special cases, the pilot may cancel an activity early for safety reasons or due to the condition of the passenger, whereupon the activity is also deemed to have been carried out. If the passenger appears at booking under the influence of drugs or alcohol, the activity will be refused and the activity will be deemed to have been carried out.
11.2. weather decision
The weather decision will be communicated to the customer by the pilot in accordance with the information in the confirmation email. If the weather is uncertain, the weather decision can also be made at shorter notice. The customer also has the opportunity to check the weather forecast with the pilot or base manager before the actual weather decision is made.
11.3. Participant requirements
In order to take part in certain experiences, there are special physical requirements such as maximum body weight and maximum height. It is the participant's responsibility to check and comply with these requirements. The specific restrictions can be viewed for each experience. If a guest is rejected on site due to these physical requirements, the voucher or ticket and the entitlement to the booked experience will be forfeited.
12.1 General information
Most of the experiences on offer take place outdoors in nature and are dependent on wind and weather. Postponements can therefore always occur, even at short notice before the planned launch. Safety is our top priority.
12.1. Balloon flights
Balloon flights are highly dependent on wind and weather. Predefined launch sites can therefore not be guaranteed and will be checked by the pilot at short notice and, if necessary, moved to an alternative site.
12.2. Paragliding flights
If the minimum flight duration of approx. 30 minutes is not reached during a thermal flight, the passenger will be refunded the price difference to a panoramic flight as a voucher. Flights from the Rigi and Pilatus are excluded. A cash refund is only possible if the registration was made without a voucher. If the thermal flight is aborted by the passenger before the minimum flight duration of approx. 30 minutes has been reached, the thermal flight is deemed to have been flown and no refund will be due.
12.3. aircraft type
Unless a specific aircraft type is mentioned in the offer, the optimum type will be selected by the pilot. The photos on the offer page and catalogs do not always show the type of glider used.
13.1 Deliveries
Complaints regarding damage, loss or poor packaging must be reported to Flightbase and the carrier in writing immediately upon receipt of the goods, and concealed differences in quantity within 4 days of receipt of the goods.
13.2 Activities
If the customer has cause for complaint or suffers damage, this must be reported in writing to the organizer within 5 days and confirmed. This confirmation is not an acknowledgement of guilt. The address of the responsible organizer can be requested from Flightbase. The organizer will endeavor to remedy the situation within the scope of the event and the possibilities. If no or insufficient remedial action is taken or if the customer wishes to assert claims for damages, the claims must be submitted in writing to the organizer and a copy to Flightbase within 2 weeks of the contractual end of the activity. The complaint must be accompanied by confirmation from the organizer and any evidence. All claims are forfeited if the complaint is submitted late or not submitted at all during the activity or if the claim is submitted late.
Flightbase offers are all considered non-risk sports. Non-occupational accident insurance (e.g. SUVA) and health insurance must be in place and are the responsibility of the participant and must be presented on site on request. Cancellation insurance is recommended and is the responsibility of the participant.
15.1 Damages
Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved. Liability claims arising from a flight experience must be addressed to the organizer. If a participant does not follow the instructions of the organizer, activity leader, etc., any liability on the part of the organizer is void.
15.2 Private flights
Some flights offered by Flightbase are private flights within the meaning of the Aviation Ordinance SR 748.01 Art. 100. For these flights, there is an insurance obligation to cover liability for personal injury and property damage. Whether a flight is operated as a private flight can be found in the text of the offer.
Trogen AR is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
The legal relationship is subject to Swiss law. Should one or more provisions of these GTC be or become invalid and/or incomplete, the invalid and/or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid and/or incomplete provision in terms of its effectiveness. The invalidity and/or incompleteness of a provision shall not affect the validity of the other provisions.
The original German version of the General Terms and Conditions shall always be legally binding.
